Issue

Industrial Rezoning Threatens Community’s Existence

In spite of significant community opposition, the local government sought to rezone land for heavy industry right next to an existing community of Wallace. The zoning ordinance text required a 2000ft distance requirement, to protect areas with a minimum residential density of 1 du/acre. The parish or the industrial applicant submitted an interpretation of residential density that made no sense, and would allow the applicant to disregard the requirement.

Solution

Legal Challenge to Zoning Ordinance

I was hired to develop an alternative analysis, that would evaluate residential density within the parish using a logically sound and defensible methodology, which demonstrates sufficient density in the community, and drew the distance requirement using GIS, to show how badly the industrial rezoning failed to meet the required setback distance from residential areas. I also prepared a written report that was filed along with a lawsuit brought by Descendants Project by Most & Associates to challenge the legality of the local rezoning ordinance. I was also able to demonstrate that a faulty outcome of the parish’s own methodology would allow industrial proliferation throughout the entire parish, and ignore the distance requirement text.

Impact

Industrial Applicant Bails on Project

While the legal fight proceeded in district court, the industrial proposal brought by Greenfield was cancelled later on that summer due in a surprising move, which resulted in a victory for the community. The merits of the legal challenge remain active and relevant in the event that some other industrial proposal seeks to locate on the rezoned land adjacent to Wallace.
